Controlling authority
Wyoming added a public-adjuster definition to its current licensing chapter. The definition focuses on a compensated insured-side role involving first-party claims for loss or damage to real or personal property. It covers negotiating or effecting settlement, and it also reaches advertising, solicitation, holding out, direct or indirect solicitation of adjusting business, investigation, adjustment, and advice to an insured. Read the verbs and the represented party together. A person cannot avoid the licensing question merely by using “claim consultant” on a website when the promised work is negotiating the insured’s property settlement. Conversely, the definition does not convert every estimator, contractor, or policy educator into a public adjuster; classify the actual services and communications.
Course takeaway: Negotiating or effecting settlement of an insured’s first-party real- or personal-property claim. Advertising, soliciting business, or holding oneself out as a public adjuster is itself listed. The public-adjuster definition includes directly or indirectly soliciting, investigating, adjusting, or advising an insured about such a loss.
