Controlling rule
West Virginia defines the role through actor, compensation, client, claim, and coverage. A public adjuster acts for the insured for value, solely in relation to a first-party claim under a contract insuring the insured’s real or personal property. The definition also reaches advertising, solicitation, direct or indirect loss investigation, adjustment, or advice for another insured-side adjuster. A title such as consultant or estimator does not control when the conduct satisfies the rule. Checkpoint: What claims fall within West Virginia’s public-adjuster definition? Compensated insured-side work solely on first-party claims under contracts insuring the insured’s real or personal property. What limits the fact-gathering or technical-assistance exception? The person must be employed only to obtain loss facts or furnish technical assistance to a licensed public adjuster.
Course takeaway: Compensated insured-side work solely on first-party claims under contracts insuring the insured’s real or personal property. Yes. Holding out, advertising, soliciting, investigating, adjusting, or advising in the defined role can qualify. Yes, but the person may not represent the insured and insurer on the same claim.
