Controlling authority
Vermont classifies claim professionals by the work performed and the party served. Under 8 V.S.A. section 4791, a public adjuster investigates claims or negotiates settlements for insureds. Advertising or soliciting that work is also within the definition, so licensing is relevant before the first paid claim is accepted. Start every intake by identifying the client, the insurance contract, the damaged interest, and the proposed services. A consultant who promises to interpret coverage and then negotiate the insured’s property claim is performing more than ordinary estimating. By contrast, a lawyer settling a client’s claim in the professional capacity of counsel is excluded from the statutory public-adjuster definition. The attorney exception follows the legal role; it is not a general exemption for employees of an adjusting firm.
Course takeaway: A person who investigates claims or negotiates claim settlements for insureds, or advertises or solicits business as such. No. The insurer.
