Authority and rule

Utah scope, license, and examination starts with the actor, authority, policy, and task. What does Utah insurance adjusting include? The supported answer is Directing or conducting the investigation, negotiation, or settlement of an insurance-policy claim for an insurer, policyholder, or claimant. Current Section 31A-26-102 reaches both directing and conducting claim investigation, negotiation, or settlement. Who does a Utah public adjuster represent? The supported answer is Insureds and claimants under insurance policies. Utah distinguishes the insured-side public adjuster from the insurer-side independent adjuster. Use the current Chapter 31A-26 text and cited Department material. Identify whether the person represents the insurer or insured, whether an exemption truly applies, and whether the required license has issued. Record every trigger in its stated unit and avoid importing another state's contract or disaster rule.

Course takeaway: Directing or conducting the investigation, negotiation, or settlement of an insurance-policy claim for an insurer, policyholder, or claimant. Insureds and claimants under insurance policies. Before performing, offering to perform, or soliciting public-adjusting work unless an exemption applies.
