Controlling rules
For role, authority, and the official examination, begin with these two rules. 1. Who does a Pennsylvania public adjuster represent? The insured on the insured’s own first-party property claim. 2. What determines whether work is public adjusting? The actual compensated insured-side conduct. Start with the controlling official source and record its date. Separate a statutory command from Department guidance, an exam-study choice, a policy condition, and a firm control. When an older regulation or summary conflicts with a later statute, preserve the discrepancy and follow the current controlling authority or obtain PID guidance. Never borrow a neighboring state rule merely because it is familiar. This source hierarchy is applied specifically to role, authority, and the official examination. Section 5(c) prohibits public-adjuster activity in personal-injury and automobile-property-damage claims, even when a policyholder requests it.
Course takeaway: The insured on the insured’s own first-party property claim. The actual compensated insured-side conduct. Series 16-19.
