Read a sample: Oregon public-adjuster scope and examination
Current authority
Oregon's public-adjuster framework is unusually recent, so oregon public-adjuster scope and examination must be taught from the rules effective August 1, 2025 and later amendments. What claim may an Oregon public adjuster handle under OAR 836-071-1100 and -1105? The supported answer is A first-party claim under insurance covering the insured’s real or personal property, excluding personal and commercial auto. The 2025 rules create a distinct insured-side property role and expressly exclude both personal and commercial auto lines. What activity can make someone a public adjuster under the Oregon rule? The supported answer is For compensation, preparing, presenting, or negotiating a covered first-party property claim, or advertising or soliciting that work. The rule looks to compensated claim representation and public holding out, not merely a chosen job title. Begin every analysis with the actor, compensation, first-party status, property form, and task. The license is limited to insured-side real or personal property claims and excludes personal and commercial auto. Cite the current OAR provision, not a proposal or a familiar rule from another state.
Course takeaway: A first-party claim under insurance covering the insured’s real or personal property, excluding personal and commercial auto. For compensation, preparing, presenting, or negotiating a covered first-party property claim, or advertising or soliciting that work. August 1, 2025.
