Controlling rule
North Dakota confines public adjusting to compensated work for an insured on the insured’s first-party real- or personal-property claim. The definition reaches negotiating or effecting settlement, advertising, soliciting, holding out, investigating, adjusting, and advising. Identify the actor, client, compensation, policy, property, and first-party relationship before work begins. A consultant, estimator, appraiser, advocate, or contractor title does not change protected conduct. Checkpoint: Whose claim does North Dakota public-adjuster authority serve? An insured’s first-party claim for loss or damage to the insured’s real or personal property. What attorney activity is exempt from public-adjuster licensure? A North Dakota-admitted attorney acting in the attorney’s professional capacity.
Course takeaway: An insured’s first-party claim for loss or damage to the insured’s real or personal property. Yes. Compensated advertising, solicitation, or holding out for that role is included. No. Section 26.1-26.8-03 prohibits that insurer-side representation.
