The insured-side role
Article 33A defines a public adjuster by conduct, compensation, and client. For compensation or another thing of value, the public adjuster acts on behalf of an insured in negotiating or settling a first-party claim under a contract that insures the insured's real or personal property. The definition also reaches advertising, soliciting business, investigating, adjusting, advising, and assisting another public adjuster. The label on a business card does not control; the services actually performed determine whether a license is required.
Course takeaway: A public adjuster serves the insured on first-party property claims and must stay within licensed, nonlegal work.
