Rule and scope

Begin by naming the principal before analyzing a task. A public adjuster serves an insured client on a first-party property claim; a staff adjuster is employed by the insurer; an independent adjuster works for an insurer-side principal under contract. The PA authority reaches real property, personal property, and loss of income. It does not convert third-party bodily-injury, life, health, or accident matters into PA work. Record who retained the adjuster, who pays the adjuster, whose interests the adjuster advances, and which coverage is being adjusted. Whom does a New Mexico public adjuster represent? The insured client. A PA acts for the insured, while staff and independent adjusters act on the insurer side. Which claims fall within a licensed PA’s express authority? Insured clients’ real- and personal-property claims, including loss of income. 13.4.8.17 ties PA authority to insured property claims and expressly includes income loss.

Course takeaway: The insured client. Insured clients’ real- and personal-property claims, including loss of income. A staff or independent adjuster license.
