Role and boundaries

The Public Adjusters’ Licensing Act requires an individual or organization acting as a public adjuster in New Jersey to hold the proper license. The public adjuster is retained by the insured to advise and assist with a property-damage insurance claim. Current statutory contract language describes services that may include evaluation, documentation, presentation, and negotiation. The role follows conduct: an estimator, contractor, consultant, or “claim advocate” who performs compensated insured-side adjustment cannot avoid licensing merely by choosing another title. The insurer’s staff or independent adjuster represents the carrier; the public adjuster’s client is the insured. The license does not authorize the public adjuster to decide coverage for an insurer, bind the carrier, perform legal services, or promise a recovery. P.L. 2025, c.84 continues the prohibition against factual misrepresentation and advice on questions of law. An adjuster may organize evidence, measure damage, prepare a documented claim, and negotiate within policy terms. Legal interpretation, litigation strategy, or advice about rights beyond licensed claim assistance belongs with qualified counsel.

Course takeaway: New Jersey licenses public adjusters who represent insureds on property claims; the current official test has 70 scored items, 210 minutes, and a 70% minimum.
