Controlling rule
Start with the statutory actor and claim. Nebraska limits this license to compensated work for an insured on the insured’s own real- or personal-property loss. The definition reaches negotiating, effecting settlement, advertising, soliciting, and directly or indirectly seeking work to investigate, adjust, or advise. A label such as consultant, estimator, or advocate does not change conduct. Liability, life, health, annuity, provider billing, and inter-insurer subrogation matters require their own legal analysis. Checkpoint: Whose claim does Nebraska public-adjuster authority serve? An insured’s first-party claim for loss or damage to the insured’s real or personal property. What attorney activity is exempt from public-adjuster licensure? An attorney admitted in Nebraska acting in the attorney’s professional capacity as an attorney.
Course takeaway: An insured’s first-party claim for loss or damage to the insured’s real or personal property. Yes. Advertising, soliciting, or representing that one performs that compensated role is included. No. Section 44-9217 prohibits a licensed public adjuster from acting in either insurer-side capacity in any circumstance.
