Read a sample: Scope and role
Scope and authority
Start classification by naming the client and the loss. A Montana public adjuster is retained by the insured and represents the insured's interests on the licensed claim. That principal relationship separates PA work from an insurer adjuster's assignment. It also limits what the PA can promise: investigation and reporting serve the insured, but they do not create power to bind the insurer. In a new file, record who retained the worker, the policy involved, whether the claim is first-party physical damage, and which communications or negotiations the worker will perform. Those facts determine whether public-adjuster authority is implicated before labels or job titles do. Worked application: Who is a Montana public adjuster? An adjuster retained by and representing the insured’s interests. Section 33-17-102 fixes the represented principal. An insured retains a paid adjuster for a property claim. Whose interests may that PA represent? The insured’s interests. Section 33-17-102 fixes the represented principal.
Course takeaway: An adjuster retained by and representing the insured’s interests. The insured’s interests. Providing an estimate to an insurer for an insured when the insured is notified of all estimate communications.
