Controlling authority

Missouri regulates missouri role, scope, and examination through a compact statute, so careful scope reading matters. Consider this issue: Which claims fall inside Missouri's statutory public-adjuster definition? The supported response is Claims under fire or allied-lines policies handled for the policyholder. Chapter 325 ties the role to fire and allied-lines policy losses and excludes other casualty-policy adjustment. Consider this issue: Who is outside the statutory public-adjuster definition when acting in the stated capacity? The supported response is An insurer employee adjusting the insurer's fire or allied-lines claims. Section 325.010 expressly excludes an agent or employee of the issuer while defining compensated insured-side activity broadly. The September 2026 review also matters because former 20 CSR 700-2 rules are marked rescinded. Historical contract or check language must not be restated as a current rule without a separate operative source. When the statute is silent, state the silence and adopt a documented firm control rather than inventing a legal mandate.

Course takeaway: Claims under fire or allied-lines policies handled for the policyholder. An insurer employee adjusting the insurer's fire or allied-lines claims. No; section 325.015 preserves the boundary against practicing law.
