The licensed role
Chapter 175, section 162 defines a public insurance adjuster by conduct. A person acting for compensation, other than an attorney acting in the usual course of the profession, is within the definition when the person directly or indirectly solicits an insured or the insured's representative, or performs services under an agreement to represent the insured in assessing damages, negotiating, settling, appraising, or participating in a reference of a property loss. “Reference” is the statute's claim-resolution term; it does not mean merely referring a customer to another business. The listed coverage includes fire, homeowners, commercial multi-peril, business interruption, fidelity or crime, inland marine, ocean marine, and other property-damage insurance. The represented principal is the insured. A company adjuster or insurer-retained independent adjuster serves the carrier and is a different role.
Course takeaway: Massachusetts licenses compensated insured-side property loss representation and tests it in an official 100-scoreable-question examination.
