The represented side and covered claim types
Maryland Insurance Article § 10-401 defines a public adjuster by conduct and compensation. A person acts for an insured, for compensation or another thing of value, in negotiating or effecting settlement of a first-party claim under a policy insuring the insured's real or personal property. The definition also reaches solicitation for that work and a person who investigates, adjusts, or advises on such claims for another public adjuster. Section 10-403 therefore requires a license before acting in Maryland. Marketing that merely distributes advertising materials may be unlicensed, but the marketing exception does not authorize advice, solicitation that crosses into licensed conduct, contract execution, claim investigation, or negotiation. The safest intake practice records who did what and stops unlicensed personnel before they perform a licensed task.
Course takeaway: Maryland regulates paid first-party real- and personal-property claim advocacy; job titles do not change the conduct being licensed.
