Authority and rule
Classify the worker before classifying the task. A consultant retained only by an insurer occupies a different statutory role from an insured-retained advocate, even when both inspect the same roof and use the same estimating software. Record the principal, employment relationship, compensation source, and requested functions. If the engagement includes investigating, reporting, or adjusting for the named insured, the public-adjuster definition and license requirement control before the first representation is made. Worked application: Who is an adjuster under Hawaii law? An individual acting solely for the insurer or insured as an independent contractor or its employee who investigates, reports, or adjusts for the principal. Section 431:9-105 combines actor, exclusive side, work relationship, principal, and claim functions. Who does a Hawaii public adjuster serve? The insured named in the policy, whose financial interests the adjuster solely represents. The public-adjuster definition is an exclusive named-insured role.
Course takeaway: An individual acting solely for the insurer or insured as an independent contractor or its employee who investigates, reports, or adjusts for the principal. The insured named in the policy, whose financial interests the adjuster solely represents. Acting as, being appointed as, or holding oneself out as an adjuster, absent the declared-event exception.
