Conduct, representation, and compensation
General Statutes § 38a-723 defines a public adjuster by work and how the person presents the business. For monetary or other compensation or anything of value, the adjuster acts for an insured to prepare, document, and submit a first-party property claim for loss by a covered peril under a personal or commercial risk policy, or negotiates, adjusts, or effects settlement. Advertising, solicitation, and holding out as engaging in those activities as a business also fall within the definition. The represented party is the insured. A carrier employee or insurer-retained independent adjuster serves a different principal. A job title such as estimator, consultant, or advocate does not remove licensing when actual conduct satisfies the definition.
Course takeaway: Connecticut regulates compensated first-party property claim preparation, submission, negotiation, and settlement for insureds.
