Controlling concept

Arkansas does not offer a public-adjuster license or a public-adjuster licensing examination. The Arkansas Insurance Department states in Bulletin 14A-2020 that unlicensed public adjusting is illegal and asks that a person or entity seeking compensation from an insured for providing insured-side adjusting services, when not a licensed attorney, be reported. This course therefore teaches property-claim and consumer education. It does not qualify a nonlawyer to advertise, negotiate, prepare, present, or settle claims for insureds for compensation. A consumer may organize and present the consumer’s own claim. A friend can share general education, but compensation, solicitation, representation, negotiation, and individualized legal advice change the risk and require authoritative guidance before acting.

Course takeaway: Arkansas does not offer a public-adjuster license or a public-adjuster licensing examination. Arkansas’s ordinary insurance-adjuster definition is insurer-side. Bulletin 14A-2020 is important official agency guidance, but Arkansas now states in 23 CAR § 43-410 that bulletins and directives do not independently have the force of law. Attorneys occupy a different professional role.
